OPI Products Inc. of North Hollywood, California, announced the successful conclusion of a lawsuit filed in federal district court for trademark infringement against Beauty Treats International, Co. The lawsuit alleged that Beauty Treats manufactured and sold nail polish products in packaging that was similar to OPI’s distinctive trade dress and to OPI’s unique, iconic bottle design mark.
A permanent injunction was issued by the federal court that prohibited the manufacture and sale of the offending bottle, required the defendant to destroy its entire inventory of such bottles, and prohibited copying, counterfeiting, and colorably imitating the OPI mark.
OPI President and Chief Executive Officer George Schaeffer said, “We are delighted with the outcome of this lawsuit.This litigation is only part of a campaign to step-up our brand protection efforts globally.”
