Athena Cosmetics, the parent company of RevitaLash Cosmetics, has won another Federal court battle against counterfeits.
Last year, a federal jury ruled unanimously in favor of RevitaLash in a case against the same defendants—AMN Distribution, Inc. and Moishe Newman.
The defendants’ website is called BrushExpress. The company also has numerous stores on eBay and other online marketplaces, operating under various aliases.
The previous ruling determined that the defendants engaged in trademark infringement involving the use of counterfeiting, and breached a settlement agreement that was signed when Athena first caught them selling counterfeit products.
Athena Cosmetics Wins Over $1.1 Million in Damages
In this latest ruling, the court ordered the defendants to pay over $1.1 million in damages to Athena Cosmetics.The court found, among other things, that the defendants caused significant harm by selling counterfeit goods and breaching the settlement agreement.

Spotting Counterfeits
RevitaLash Cosmetics advises consumers to identify counterfeit products, but says that this can be difficult, stating that they are often skillfully crafted to look like the real thing.Checking for key details like missing shrink-wrap, pungent odors, discolored or sticky product formulas, damaged/expired boxes (or no box at all), and missing inventory control numbers can help determine whether or not a particular product is genuine.
"Additionally, keep an eye out for misspellings which can often be indicative of a fake item," the brand advises.
Buying direct from the brand's website or an authorized reseller ensures product safety. RevitaLash's customer service team is standing by to address any concerns by answering calls and emails to help consumers identify authorized resellers and counterfeit products.
